OFF & OUT RELEASE OF LIABILITY

KNOW ALL PERSONS BY THESE PRESENTS: That I, for and in return for sufficient, good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, do hereby release and forever discharge Off & Out, their agents, servants, employees, successors and assigns, and their respective heirs, personal representatives, affiliates, successors and assigns, and any and all persons, firms or corporations liable or who might be claimed to be liable, whether or not herein named, none of whom admit any liability to the undersigned, but all expressly denying liability, from any and all actions, causes of action, lawsuits, claims and demands which I now have or may hereafter have, arising out of or in any way relating to any and all injuries and damages of any and every kind, to both person and property, and also any and all injuries and damages that may develop in the future, as a result of or in any way relating to the following: Off & Out Cactus Club Hikes. It is understood and agreed that this release is made in full and complete settlement and satisfaction of the aforesaid actions, causes of action, claims and demands; that this Release contains the entire agreement between the parties; and that the terms of this Agreement are contractual and not merely a recital. Furthermore, this Release shall be binding upon the acknowledgement below, and his/her respective heirs, executors, administrators, personal representatives, successors and assigns. This Release shall be subject to and governed by the laws of the State of Texas. I have read, understand and fully agree to the terms of this WAIVER AND RELEASE. I understand and confirm that by accepting this WAIVER AND RELEASE I have given up considerable future legal rights. I have acknowledged this Agreement freely, voluntarily, under no duress or threat of duress, without inducement, promise or guarantee being communicated to me. My acknowledgement is proof of my intention to execute a complete and unconditional WAIVER AND RELEASE of all liability to the full extent of the law. I am 18 year of age or older and mentally competent to enter into this waiver.

OFF & OUT PHOTO RELEASE

OFF & OUT Release and Authorization to Photograph Release executed by individual, herein referred to as Releasor, in favor of OFF & OUT LLC. In good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, Releasor hereby consents to being the subject of photographs of Releasee, together with any subject matter owned by Releasor, and hereby authorizes Releasee to cause the same to be exhibited, with or without advertising sponsorship, as still photographs, transparencies, motion pictures, television, video or other similar media. Releasor hereby releases Releasee, and any associates, as well as any assignees, from any and all claims for damages for libel, slander, invasion of privacy or any other claim based on use of the above described material(s). In witness whereof, Releasor has executed this Release for the OFF & OUT event Releasor is attending.
